Miss GiraffeCharles H. Nguyen has been charged with rape against an Athens woman. First of all, his lawyers say if the defendant can pass a lie-detector test, then he's good.
The judge's response? “I don’t want to hear the word ‘polygraph’ associated with this case again.”

Now,
Nguyen's attorneys are also asking "to be allowed to set up, in front of a jury, the bed in which the rape allegedly took place, and then to require the alleged victim to physically demonstrate how her body was situated when she claims the assault occurred."
Excuse me? What do you think of this? Should the judge agree, or are the attorneys grabbing whatever they can reach?

well.....that's disturbing. What can come of that? That is what I'm trying to figure out. How is her "position" during a rape going to clear his name? I'm confused....that just seems like the last thing a rape victim should have to deal with. :(
I don't know enough about the case, but I'm trying to figure out how that plays a part in proving his innocence or lack thereof.
Sticky situations like this make me cringe. He said, she said, unless there's some other kind of proof. This kind of thing is really out of the question, though.
I think thats pretty tramatic and embarassing. I would not want to get up in front of anyone and show them how I was raped.

You have to admit that some rape accusations don't occur, so if that's the case, then this is all gravy. Of course, this is the mentality Nguyen and his lawyers have.
But considering the rape actually happened, God.. that's more than enough. If I was the judge, I'd stop at the description of the rape. This would be traumatizing for the victim, but the sad thing is that if she gets that traumatized look on her face, the jury will see it, be compassionate, and she will win the case. Joke would be on Nguyen's lawyers.
Yes, she would win, happy thing, but I say it's also a sad thing because it had to go that far for her to win a case.

I don't think it should be allowed. Whether he's guilty or not, the jury will be convinced by a demonstration so brutal.
But the national institute of science did a huge multi million dollar study on polygraphs and found them to be about as accurate as flipping a coin. I agree, those should be banned from court rooms as evidence.
Everyone commenting on this seems to assume he's guilty. Maybe there's something I don't know that everyone else does.
Why is there an automatic assupmtion that she was actually raped? The fact is (as in most rape cases) the only two people that know the actual truth with 100% certainty are the two people involved. Thus, you try to get as much evidence as you can in your favor.
The defendent wants a polygraph test...and at least appears confident that he is innocent. Meanwhile, the objection offered by the woman in terms of the bed-setup isn't that it would be too traumatic....but that she wouldn't have anywhere to sleep!
This is a pretty sensitive topic. And if she was raped, then it really is tough to ask her to demonstrate the position. On the other hand, the consequences of getting the verdict wrong are too high. We're talking about a 35 year long prison sentence here. As painful as it might be, there is too much at stake not to explore every possible evidence that might shed light on the case.
How the fuck would that prove anything either way?? They're just trying to humiliate her into dropping the charges.
That's retarded... I mean, how is that even fair to ask from anyone? And what if she says she can't do it? Then the guy isn't guilty and he's let out to the public again?
can you say scare tactic?!?!? that is absurd. it is bad enough o have to describe them in detail. she will probably break down if she sees the bed and the man in the same room. which makes her testimony questionable. she has to keep it together on the stand in order to make sense to the jury. this is purely to break the case down by cruel and unusual punishment.
